When asking the court to grant a springboard injunction, there has long been debate over the nature and duration of injunction that is necessary to counteract the unfair advantage gained by an alleged wrongdoer.  In the recent case of Aquinas, the High Court has given new guidance on the correct tests both for quantifying any unfair head start gained, and for aiming to restore the commercial balance between the parties through springboard relief.
