The UK Supreme Court issued the decision on the CFC & Dividend Group Litigation case led by Prudential on the 25th July 2018.
The decision hopefully signals an end to a long lasting litigation against HMRC, brought by companies receiving overseas portfolio dividends who claimed that the taxation of those dividends was discriminatory compared to the taxation of dividends received from UK companies throughout the period 1990 - 2009.
