Summary

The Upper Tribunal (UT) has decided that the sale of a new dwelling converted from a building used formerly for a mixture of commercial and residential purposes will only be zero rated if no part whatsoever of the new dwelling was formerly residential. Developers, architects and contractors will have to consider this carefully, and if zero rating is not available, seek to maximise the 5% rate available for conversion costs.
